A married Miami man who took his wife’s last name is being accused of fraud by the state and they have revoked his driver’s license.

He offered to change his name as an act of love so his wife’s Vietnamese family could keep their surname. Shortly after the change, he got a new passport, social security card, and changed his bank accounts and credit cards, and got a new license.

About a year later, the DMV sent a letter to him accusing him of “obtaining a driving license by fraud.” They told him he had to pay to have his name legally changed in a court of law. He explained he was changing his name due to marriage and they said “that only works for men.”

They’ve suspended his license and he’s appealing that now.

His lawyer says it goes beyond just this one case….what happens when a gay couple want a name change?
